WORK BASED VISAS

The Immigration and Nationality Act offers a yearly at the very least of 140,000 employment-based immigrant visas which are divided into five preference categories. They may require a labor certification from the U.S. Department of Labor (DOL), and the filing of a petition with United States Citizenship and Immigration Services in the Department of Homeland Security (USCIS).

The cost of each immigrant visa application processing fee (per person) is (US) $335. Fees have to be paid for each intending immigrant, irrespective of age, and are not refundable. Local currency equivalents are acceptable. Fees should not be sent to the consular office unless requested specifically. USCIS charges additional fees for filing petitions.

H-3 Trainees
  • Foreign nationals to receive training which is not available in their country

  • Foreign nationals as special exchange visitors to receive training in educating children with physical, mental or emotional disabilities

  • Multinational companies to send their foreign employees to the U.S. for on-the-job training

Eligibility Criteria for H3 Trainee Visa:

The sponsoring employer have to demonstrate that the:

  • Suggested training is not giveed in the beneficiary's home country;
  • Position for beneficiary will not be one of the normal operation of the business and which citizens and resident aliens are regularly employed.
  • Beneficiary will be employed, specific to training only.
  • The beneficiary will benefit in pursuing a career outside the U.S.
